Terms of Service & User Agreement

The Nearrby Service is operated by Nearrby sp. z o.o., with registered office at ul. Przykładowa 1/2, 00-001 Warsaw, Poland. Company register (KRS) no. 0000000000, tax identification number (NIP) 0000000000, statistical number (REGON) 000000000.

Support, moderation and legal contact: contact@nearrby.app. We aim to respond to support and moderation enquiries within 24 hours.

Nearrby is strictly for adults. You must be at least 18 years old to download, register for, or use the Service. This is an absolute requirement with no exceptions. We do not knowingly allow anyone under 18 on the platform.

During registration you must provide your date of birth. If it indicates you are under 18, your registration will be refused. If we later discover that an account belongs to a minor, that account will be deleted immediately and permanently, without refund. We may require age or identity verification at any time (for example, email confirmation, SMS verification, or a photo/selfie check) and may suspend features until verification is completed.

One account per person. You may not create multiple accounts, impersonate another person, transfer your account, or share your login credentials with anyone. You are responsible for all activity carried out through your account.

Nearrby is a location-based social discovery and messaging service for adults. It lets you create a profile, discover other users nearby, view their profiles, filter results by preferences, exchange text messages, voice notes, photos and stickers, and express interest in other users. The Service is intended to help users meet new people; it does not conduct criminal background checks, verify identity beyond the measures described here, or guarantee the accuracy of any profile or message.

Core features are free. Optional premium features may be offered via in-app purchases or web subscriptions (for example, advanced filters, enhanced visibility, or additional profile controls). Prices and feature sets are shown before purchase and may change with notice for future billing periods.

Nearrby has a zero-tolerance policy for harassment, bullying, hate speech, threats, abuse, intimidation, discrimination, stalking, doxxing, defamation, revenge porn, sexual harassment, sexual violence, or any unlawful, harmful, or predatory behaviour. The following is strictly prohibited and will result in immediate content removal and a permanent ban:

• Harassment and bullying: repeated unwanted contact, insults, threats, mockery, intimidation, coercion, or any behaviour intended to humiliate, distress, or harm another user.
• Hate speech and discrimination: content that attacks, demeans, or promotes violence or hatred against individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, age, or any other protected characteristic.
• Threats and violence: explicit or implied threats of physical harm, sexual violence, property damage, or any other violent act.
• Spam and scams: unsolicited bulk messages, repeated identical messages, phishing, financial fraud, investment or crypto schemes, romance scams, requests for money, gift cards, payment details, or any other fraudulent activity.
• Exploitation and sexual content: nudity, sexually explicit material, sexualised content involving minors, prostitution, escort services, solicitation, or links to adult monetised platforms.
• Impersonation and false identities: fake profiles, catfishing, stolen photos, or misrepresentation of age, identity, location, or intentions.
• Automation and data theft: bots, scrapers, crawlers, reverse engineering, bulk collection of profiles or photos, or any attempt to circumvent our technical protections.

We reserve the right to remove any content or account that violates these rules, or that we reasonably believe poses a risk to other users, without prior notice or refund.

Every user profile and every chat conversation includes easily accessible Block and Report tools. These tools are available with a single tap and are designed to give you immediate control over your experience.

• Block: Blocking a user immediately prevents them from contacting you or viewing your profile. You can block any user at any time.
• Report: Reporting a user or a message sends the relevant profile, conversation, and your reason for reporting to our moderation team. Reports can also be submitted by email to contact@nearrby.app.

We commit to reviewing all reports within 24 hours. Depending on the severity, we may warn the reported user, hide or delete content, limit features, suspend the account, or permanently ban the account immediately and without prior notice. Serious matters involving illegal activity, threats to safety, or minors may be reported to law enforcement.

We may remove content, restrict access, or permanently ban any account that violates these Terms, our policies, or applicable law, or that we reasonably believe harms the safety, integrity, or reputation of the Service. This includes content reported by users and content detected through our moderation systems.

Violating content will be removed immediately. Accounts that violate our zero-tolerance policies will be banned permanently. A banned user may not create a new account without our prior written permission. We are not obliged to provide a refund for any paid subscription or purchase associated with a banned account.

Nearrby uses your device's location to show you users nearby and to let you search for users in a city or area you select. Your location data is used only for:

• sorting nearby profiles by approximate distance,
• matching you with users in a selected city or area, and
• displaying an approximate distance band to other users (for example, "1–3 km").

We never display your exact GPS coordinates to other users. Other users see only an approximate distance band and the city or area you have chosen. You can disable location access at any time in your device settings; doing so may limit the nearby discovery feature but will not stop you from using the city-search or manual pin-on-map features.

Location access requires your consent. On iOS, you can grant or revoke permission in Settings → Privacy & Security → Location Services → Nearrby. If you deny permission, we will prompt you with instructions on how to enable it. Location data is handled in accordance with our Privacy Policy.

Nearrby is a platform for online introduction only. We are not responsible for the conduct of any user outside the App, including during or after any real-world meeting. We do not conduct criminal background checks on users, and we cannot guarantee the identity, age, intentions, or truthfulness of any profile or message.

Stay safe when meeting people offline:

• Meet in public places and tell a friend or family member where you are going.
• Use your own transport and avoid sharing your home or work address.
• Do not send money, share financial details, or accept investment advice from anyone you meet.
• Trust your instincts: if something feels wrong, leave the situation and report the user.
• Do not share passwords, verification codes, or other sensitive information.

By using Nearrby, you acknowledge that you meet other users at your own risk and that the operator is not liable for any injury, loss, damage, or dispute that occurs offline or outside the Service.

You retain ownership of the photos, text, voice notes, and other content you upload ("User Content"). By uploading it, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt (for resizing, formatting, and moderation), and display it within the Service for as long as it remains on the platform. You confirm that you hold all rights to your content and that it does not infringe anyone else's rights, including privacy, publicity, or intellectual property rights.

You must not upload content that is illegal, obscene, threatening, hateful, or that violates these Terms. We may remove or refuse to display any content at our discretion. The App's source code, branding, design, and the "Nearrby" name and logo are our property and may not be copied, modified, or used without our written permission.

Premium features, if available, are offered via subscription or one-time purchase. Subscriptions renew automatically at the then-current price unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions through your Apple App Store or Google Play account settings, or through the web subscription settings in the App.

EU/EEA consumers have a 14-day right of withdrawal for digital content purchases. By starting to use a premium feature immediately after purchase, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once the service has been fully performed. Refund requests must be sent to contact@nearrby.app.

You can delete your account at any time in Settings → Delete account. Deletion removes your profile, photos, messages, matches, and other account data from the live Service. Backups and server logs are purged within 30 days, except data we are required to keep for legal, security, fraud-prevention, or accounting reasons.

We may suspend or terminate your account for any breach of these Terms or for any reason that we reasonably believe protects the safety, integrity, or lawful operation of the Service. Termination does not entitle you to a refund.

To the fullest extent permitted by law, Nearrby sp. z o.o. is not liable for the conduct of users, for offline meetings or events, or for indirect, incidental, consequential, or special damages, including emotional distress, loss of reputation, or financial losses resulting from interactions on or off the Service. Nothing in these Terms excludes liability that cannot be excluded by law, including death or personal injury caused by our negligence or intentional misconduct. Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months preceding the event.

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email at least 30 days before they take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and delete your account.

These Terms are governed by the laws of Poland, without limiting the mandatory consumer protections of your country of residence. We aim to resolve disputes amicably. Consumers may also use out-of-court dispute resolution bodies or the courts of their place of residence.
